Intellectual Property Protection Policy

This Intellectual Property Protection Policy ("Policy") describes how Where 2 Buy ("we", "our", or "us") protects and licenses intellectual property related to the Where 2 Buy application and website (the "Service"). This Policy supplements our Terms of Service. By using the Service you agree to this Policy.
1. Our Ownership
Unless otherwise stated, we own or licence all intellectual property in the Service, including but not limited to:
- The Where 2 Buy name, logo, and branding
- Application source code, design, layout, and user interface elements
- Original text, graphics, and other content we create for the Service
- Compilation, selection, and arrangement of content on the Service
All such materials are protected by copyright, trademark, and other intellectual property laws in Canada, the United States, and other jurisdictions. All rights not expressly granted to you are reserved.
2. Third-Party Content
The Service displays product information, prices, store names, logos, images, and weekly flyers sourced from third parties (including SerpAPI, Flipp, Google Maps, and retailers). We do not claim ownership of third-party trademarks, logos, product images, or pricing data. Those materials remain the property of their respective owners and are used for informational purposes under applicable licences or fair-use principles.
References to third-party brands do not imply endorsement, sponsorship, or affiliation unless explicitly stated. Your use of third-party content is also subject to the terms and policies of those third parties.
3. User Content
You retain ownership of content you submit to the Service (for example, your display name, saved product lists, and store preferences). By submitting user content, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display that content solely to operate, maintain, and improve the Service.
You represent that you have the right to submit any content you provide and that it does not infringe the intellectual property or other rights of any third party.
4. Permitted Use
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial purposes in accordance with our Terms of Service and this Policy. You may not:
- Copy, modify, distribute, sell, or lease any part of the Service or our content
- Reverse engineer, decompile, or attempt to extract source code except where law permits
- Use automated tools, bots, or scrapers to access or harvest data from the Service
- Remove or alter copyright, trademark, or proprietary notices
- Resell, sublicense, or commercially exploit data obtained from the Service without our prior written consent
5. Restrictions
You agree not to:
- Use our trademarks, logos, or branding without prior written permission
- Create a product or service that is confusingly similar to Where 2 Buy
- Frame or mirror any portion of the Service without authorization
- Misrepresent your relationship with Where 2 Buy or imply our endorsement
6. Copyright and Trademark Complaints
If you believe content on the Service infringes your copyright or trademark, please send a written notice to our designated contact at hello@where2buy.app with the subject line "Intellectual Property Notice". Include:
- Identification of the copyrighted work or trademark you claim is infringed
- Identification of the material on the Service and its location (URL or description)
- Your contact information (name, address, email, and phone if available)
- A statement that you have a good-faith belief the use is not authorized
- A statement, under penalty of perjury where applicable, that the information in your notice is accurate and that you are the rights holder or authorized to act on their behalf
- Your physical or electronic signature
We may remove or disable access to material that we believe, in good faith, infringes intellectual property rights. We may terminate accounts of repeat infringers where appropriate. Counter-notices and disputes will be handled in accordance with applicable law.
7. Changes to This Policy
We may update this Policy from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Service after changes constitutes acceptance of the updated Policy.
8. Governing Law
This Policy is governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-law principles, consistent with our Terms of Service.
